PART I
PRELIMINARY
Short title and commencement.
1.

This Act may be cited as the Electronic Communications Act, 2010, and shall come into
force on a date to be determined by the Minister by notice in the Gazette.

Application.
2.

(1) This Act applies to the regulation of electronic communications and matters related to
electronic communications.

(2) This Act does not apply to the content of messages transmitted through an electronic
communications network.
(3) This Act is without prejudice to the operation of any other law regulating content in
electronic communications.
Interpretation.
3.

In this Act, unless the context otherwise requires -

"access" means the making available of facilities or services, to another licensee, under defined
conditions, on either an exclusive or non-exclusive basis, for the purpose of providing
electronic communications services, and includes -
