(ii)
report in the prescribed form and manner to the Director-General: State
Security regarding the outcome of the audit,
as contemplated in subsection (4);
(d)
furnishes—
(i)
a report referred to in subsection (4); or
(ii)
any additional information referred to in subsection (5),
to the Director-General: State Security which he or she knows to be false or
which he or she does not know or believe to be true; or
(e)
fails to provide, within the specified time period the additional information
requested by the Director-General: State Security as contemplated in
subsection (5),
is guilty of an offence and is liable on conviction to a fine or to imprisonment for a period
not exceeding three years, or to both such fine and such imprisonment.
(11)
(a)
Any person who—
hinders or obstructs any member, person or entity to monitor, evaluate and
report on the adequacy and effectiveness of an audit as contemplated in
subsection (3);
(b)
hinders or obstructs a person authorised to carry out an audit in the exercise of
his or her powers or the performance of his or her functions or duties in terms of
subsection (6);
(c)
fails to accompany a person authorised to carry out an audit as contemplated in
subsection (7)(c); or
(d)
fails to assist or provide technical assistance and support to a person authorised
to carry out an audit as contemplated in subsection (8),
is guilty of an offence and is liable on conviction to a fine or to imprisonment for a period
not exceeding two years, or to both such fine and such imprisonment.
CHAPTER 8
