(i)

an offence under Chapter 2 of this Act;

(ii)

any other offence in terms of the laws of the Republic which may be
committed or facilitated by means of an article; or

(iii)

an offence—
(aa)

similar to those contemplated in Chapter 2 of this Act; or

(bb)

any other offence substantially similar to an offence recognised in
the Republic which is or was committed by means of, or facilitated
by the use of an article,

in a foreign State.
(3)

The National Director of Public Prosecutions must consider a

request by a head of a law enforcement agency in terms of subsection (2) and may only
grant approval referred to in subsection (2) if he or she is satisfied that the forwarding
of information —
(a)

will not affect any pending criminal proceedings or investigations adversely
regarding criminal offences committed within the Republic; and

(b)

is in accordance with any applicable law of the Republic.
(4)

A law enforcement agency may receive any information from a

foreign State which will—
(a)

assist the law enforcement agency in the initiation or carrying out of
investigations regarding an offence committed within the Republic; or

(b)

lead to further cooperation with a foreign State to carry out an investigation
regarding the commission or intended commission of—
(i)

an offence under Chapter 2 of this Act; or

(ii)

any other offence in terms of the laws of the Republic which may be
committed by means of or facilitated by, an article.
