DISCRETIONARY PO\VER

40. Except as otherwise provided in these Rules, before
exercising any discretionary power given to him by the Act
or these Rules adversely to any applicant for registration of
a design, the Registrar shall give at least ten days' notice to
the applicant of the time when he may be heard.
PO\VER TO DISPENSE \VITH EV.IDENCE

41. Where under these Rules, any person is required to
do any act or thing, or any document or evidence is required
to be produced to or lodged with the Registrar or at the
Office, and it is shown to the satisfaction of the Registrar
that from any reasonable .cause such person is unable to do
such act or thing, or that such document or evidence cannot
be produced or lodged as aforesaid, it shall be lawful for the
Registrar, and upon the production of such other evidence
and subject to such terms as he thinks fit, to dispense with
the doing of any such act or thing, or the production or
lodging of the document or evidence.
A~fENDMENTS

42. If the Registrar thinks fit any document or drawing or
other representation of a design may be amended, and any
irregularity in procedure may be rectified, on such terms as
the Registrar may direct.
ENLARGEMENT OF TlivfE

43. The times prescribed by these Rules for doing any
act, or taking any proceeding thereunder, may be enlarged
by the Registrar if he thinks fit, and upon such notice to the
parties and upon such terms, as he may direct, and such
enlargement may be granted though the time has expired
for doing such act or taking such proceeding.

44. (1) Where a certificate is required for the purpo?e of
obtaining registration abroad, or for any legal proceedi n.gs,

which the Registrar is authorised by the Act or these Rules
to make or do, the Registrar mayan the lodging of a request
on Desians Form No. 19, give such certificate, which shall
also s'pe~ify on the face of it the purpose for which it has
been issued as aforesaid.
