sound recording until the end of the fiftieth calendar year
following the year of fixation,
(3) For the purposes of this section, a sound recording
that has been made available to the public by wire or
wireless means in such a way that members of the public
may access it from a place and at a time individually
chosen by them shall be considered as if it has been
published for commercial purposes,
Obligation of
producers
45, ( 1 ) The producer of a sound recording or audio visual
work shall state on the label of the sound recording or
audio visual work or on its container
(a) the name of the author and those of the main
performers;
(b) the title of the work;
(c) the year the original matrix was cut;
(d) the individual or corporate name or the
distinguishing mark of the producer; and
(e) that the rights accru i n g to the producer under
this Act are reserved,
(2 ) ChOirs, orchestras and composers shall be referred
to by their proper names or by the name of the leader for
the purpose of paragraph (a) of subsection (1)(a),
