33. (1) The functions of the Commission shall be to—

promote the protection and observance of the right
to privacy;
monitor, investigate and report on the observance
of the right to privacy;
formulate, implement and oversee programmes
intended to raise public awareness of the right to
privacy and obligations;
receive and investigate any complaint relating to
infringement of the rights of a person under this
Act;
provide a framework or mechanism for the
effective management of conflicts and the
resolution of disputes under this Act; and
perform such other functions as may be prescribed
by any other law or as the Commission may
consider necessary for the promotion and
protection of human rights.
(2) The Commission shall, in performing its functions
under this Actbe guided by the national values and principles of
governance under Article 10 of the Constitution;
have regard to the applicable international
information management and dissemination
standards relating to data protection;
ensure that agencies have put in place adequate
safeguards for the protection of personal data;
take statements under oath in relation to any
investigation it is undertaking; and
take such action as may be necessary for the
performance of its functions under this Act.
(3) The Commission shall have all the powers
necessary for the performance of its functions under this
Act.
34. (1) A data subject who is aggrieved by a decision
of any person under this Act may lodge a complaint with
the Commission in accordance with this Act.
